KAIVA LLC respects intellectual property rights and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512).

Reporting infringement

If you believe content on Kaiva infringes your copyright, send a written notice to our designated agent containing: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material and enough information for us to locate it; (3) your name, address, telephone number, and email; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and (6) your physical or electronic signature.

Misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. § 512(f).

What we do

On receiving a valid notice we will remove or disable access to the material (and cancel production of any affected not-yet-produced card) and notify the user who submitted it.

Counter-notice

If your content was removed and you believe that was a mistake or misidentification, you may send our agent a counter-notice containing: your contact information; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification; consent to the jurisdiction of the federal court for your district (or, if outside the U.S., the Central District of California) and to service of process from the original complainant; and your signature. We may restore the material in 10–14 business days unless the complainant files a court action.

Repeat infringers

We terminate the accounts of users who repeatedly infringe, in appropriate circumstances.
